TERMS AND CONDITIONS

Online shop, operating at www.sklep.exoriente.pl run by ALATUS Edyta Wittchen, established in Warsaw at ul.Freta 16, 00-227 Warszawa, entered in the Municipality Register on 11.09.1998 - number 308939, Tax Identification Number 972-049-13-50, REGON 015211231.


PARTIES TO THE TRANSACTION

1. The party making the purchase in the online shop www.sklep.exoriente.pl, hereinafter the Buyer, is an entrepreneur or a person with full legal capacity.

The party making the sale of products included in the offer of the online shop www.sklep.exoriente.pl is the owner of the shop - company ALATUS Edyta Wittchen, hereinafter the Seller.

2. The condition of carrying out a transaction is Registration /for customers who have not made any previous purchases in www.sklep.exoriente.pl / and acceptance of the herein Terms and Conditions and other conditions of sale.

3. The subject of transaction are all items presented on the website www.sklep.exoriente.pl at the time the Buyer places an order. All prices are shown in Polish Zloty /PLN/ and include VAT unless the offer provides otherwise. The price of the contract is binding at the time of order. The price of items unavailable at the time of order may be subject to change.

4. In the event of promotion sales, in which the number of items is limited, the performance of contract depends upon the order of receipt of order.

5. The Seller reserves the right to change the price of products in the offer, add and withdraw products, carry out and end promotion campaigns at any time.

6. Online orders can be made 24 hours a day throughout the year. In exceptional circumstances orders can be made by phone at +48 22 635 10 36, mobile phone: +48 693 287 989 or by email at www.sklep.exoriente.pl. Orders made on weekdays after 5p.mm, on Saturdays and Sundays will be considered on the next business day.

7. The contract is binding upon receipt of feedback from the Seller confirming the order.

8. Modifications of the order are possible until the order has not yet been sent. The change of delivery address after completion of shipment involves an additional cost.

9. The condition of carrying out a transaction is the availability of the product in the warehouse or from the supplier at the time the Buyer places the order. If part of the ordered goods is not held in stock, the Buyer will be informed of the order status so that he can decide on the performance of the contract. In this event the Buyer has 2 days to modify the submitted order. After this deadline, the contract shall be considered not valid.

10. The Seller reserves the right to review the order. In cases of legitimate doubts and when the herein Terms and Conditions are not respected the Seller will withdraw from the order.

11. The Seller shall use his reasonable endevours to meet any date agreed for delivery. However, the time of delivery depends on the availability of the product, time required for the completion of the order and the shipping time, therfore the Seller shall not be liable for any delay in delivery howsoever caused

12. The Buyer can choose one of the following forms of payment:

  • in cash or by credit card - upon the receipt of the product from the shop

  • by credit card or electronic money transfer via PayPal

13. All delivered goods must be signed for by the Buyer on delivery and the authorised signature will be treated as evidence of compliance of the delivery with the order. The risk or damage to or loss of the products shall pass to the Buyer upon delivery.

14.The Buyer is obliged to check the contents of the consignment to ascertain there are no damages to the product due to transportation and that the delivery is complete . Qualitative and quantative complaints will be considered only if the Complaint Protocol is drawn up on delivery. When buying over the counter, the Buyer is also obliged to check the purchases for damages.

15. Under the Consumer Protection Regulations of 2 March 2000 the Buyer has the right to cancel the order, not stating the reason, within 10 days of delivery and receive a full refund for any item.This point is not applicable to goods purchased over the counter in the Gallery Ex Oriente.

16. When the goods are collected directly from the Gallery Ex Oriente and paid for in cash, the Buyer is obliged to collect all purchases by the end of the next business day after receiving notification that the products are ready for collection.

17. The Seller bears no responsibilty for errors made by the Buyer in the order form in the result of which the delivery failed to reach the addressee or for unjustified refusal to accept the shipment.

18. While every effort is made to ensure the offer is presented according to the actual design, photographs shown on our website www.sklep.exoriente.pl are for illustrative purpose only and may not match the product itself exactly and therefore may not be basis for complaint. In case of any doubts or queries please contact the Seller.

RETURNS

Under the Consumer Protection Registration of 2 March 2000 the Buyer has the right to cancel the order, not stating the reason, within 10 days of delivery and receive a full refund for any item.

1. Items which have been damaged mechanically or chemically as well as those items whose original packaging has been damaged are not refundable.

2. The Buyer is obliged to deliver the Returned product within 7 days from receiving the confirmation of acceptance of Return from the Seller.. The Buyer`s failure to deliver the claimed product within 7 days will cause the withdrawal of the declaration of withdrawal.


WARRANTY TERMS PROVIDED BY ALTUS EDYTA WITTCHEN

  1. ALATUS _ Edyta Wittchen ensures smooth functioning of the product provided it is used according to its specification and instructions in the manual.

  2. Defects which appear within the warranty period will be removed free of charge by ALATUS – Edyta Wittchen. The way of removing the fault are at the Seller`s discretion, who may either repair or change the faulty part or replace the entire product with another one.

  3. ALATUS – Edyta Wittchen shall take action to repair the product within 14 days from the date of the delivery of the product to the Seller. In the case of complicated repairs, which require a lot of work or additional activities the time may be extended, while every effort will be made to repair the product in the shortest possible time.

  4.  In cases where the product will need to be replaced with another one, ALATUS – Edyta Wittchen commits to replace the product with a new one of the same type or one with similar or better operational parameters.

  5. In cases where an exchange of the product for a new one is impossible, the Buyer shall be given a full refund.

  6. Warranty claims may be denied by ALATUS - Edyta Wittchenin the following circumstances:

  7. If the claim is unfounded, the Buyer will be charged with the costs of performed service work.

  8. ALATUS Edyta Wittchen bears no responsibility for the loss, damage or destruction of the product caused by factors other than defects inherent in it. The warranty does not give the Buyer the right to claim reimbursment of lost profits associated with damage to product.


The warranty does not exclude, limit or suspend the Buyer`s rights resulting from the non-compliance of the product with the contract.


FINAL PROVISIONS

Placing an order entitles the Seller to process personal data in the ordinary course of business under conditions of secure data in accordance with the Law of 29 August 1997 regarding Privacy Policy /Law Gazette 2002 No. 101, pos.926 with amendments /. ALATUS – Edyta Wittchen does not share personal data with third parties for processing or use for marketing purposes.

This Contract shall be governed by the court having jurisdiction over the Seller`s site. The Seller is entitled to change the herein Terms and Conditions. Cases not covered by the above Rules shall apply the provision of thr Civil Laws.
